Important Developments in EB-1 Permanent Resident Applications

There are two important developments to report regarding applications for permanent resident status in the EB-1 category. The Visa Bulletin for July 2006 indicates that the visa numbers for EB-1 applications for people born in China will become current. Accordingly, starting July 1, 2006, applicants born in China can file an I-140 application concurrently with an application for adjustment of status.
Additionally, USCIS recently released a more liberal definition of the requirement of a "permanent" position for EB-1 Outstanding Researcher cases. In the past, USCIS has strictly interpreted the definition of permanent position for outstanding researcher applications. The new definition is more generous and will allow more individuals to qualify for permanent residence as an Outstanding Professor or Researcher.
