Stern Elkind & Curray recently spoke with the U.S. Department of State regarding the future availability of Schedule A visa numbers. These visa numbers are available for two groups, one of which includes those with exceptional ability in the sciences or arts (including college and university teachers), who have been practicing their science or art during the two years prior to application.
Petitions for these visa numbers are particularly attractive in many cases since the visa numbers continue to be currently available, not subject to the extensive backlogs in many other employment based categories.
However, the DOS official estimated that through end of July 2006, approximately 37,000 of the 50,000 Schedule A visa numbers will have been utilized. It is anticipated that the category will remain current through the end of FY2006 and that about 4,000 will be available at the start of FY2007, running out in November or December 2006.
For those individuals who are contemplating filing a petition as one possessing extraordinary ability in the sciences or arts, this news means that applications should be commenced in the very near future.
