Government Announces Unavailability of EB-3 Visas

June 16, 2005

The U.S. Department of State has announced that visa numbers in the Employment-based 3rd Preference category (EB-3) will be unavailable for all countries beginning June 1, 2005. This means that no applicants in the EB-3 category, with the exception of some Schedule A, applicants, will be able to file I-485 Adjustment Applications or obtain immigrant visas at a consulate abroad until more numbers are available. Also, USCIS will not be able to approve any Adjustment Applications in the EB-3 category that have already been filed. We anticipate that this situation will continue for several months.

Under recent legislation, Schedule A workers have their own subcategory, and therefore, are not subject to this visa unavailability. Schedule A includes nurses and physical therapists. There is availability of visa numbers for the Schedule A subcategory.
