Obtaining Proof of Filing of Labor Certification Application

The Department of Labor (DOL) has recently announced procedures for obtaining documentation of a labor certification application that has been sent to the backlog reduction centers. Once applicants provide information including a state case number and the approximate filing date, the DOL will issue a letter confirming the date that the application was filed, with confirmation that the application is still pending. Thus, applicants approaching the end of their sixth year in H visa status can rest assured that it is now possible to prove that a labor certification has been pending for more than one year. There is no word yet as to how long it will take to receive documentation of the filing, but check this site for any updates we receive on this process.
