USCIS Issues Guidance on I-140 and H-1B Processing Under AC21 on Issues of Job Portability, 7th Year H-1B Extensions, H-1B Portability

On May 12, 2005, USCIS issued new guidance to all Service Centers with important new guidance on the processing of I-140, I-485 and H-1B petitions where aspects of the American Competitiveness in the 21st Century Act of 2000 may be involved. The guidance is interim only, until final regulations are published as a final rule. The issues discussed are complex, and touch on many questions that have remained unanswered since the Act was signed into law. The guidance is available to download from USCIS.
