Implementation of H-2B (Temporary Workers) Legislation

Under the Save our Small and Seasonal Businesses Act of 2005 (SOSSBA), returning workers are exempted from the fiscal 2005 H-2B quota. USCIS and the State Department approximate that this will free up 35,000 cap numbers. In order to be eligible as a returning worker, the applicant need only prove that s/he held H-2B status within the past 2 years of applying for the visa at a consulate, or if visa exempt, applying for entry into the United States. USCIS has indicated that it will be ready to start receiving H-2B petitions under the new legislation on May 25, 2005. Already approved temporary worker labor certifications will be accepted as long as the date of employment has not expired.
