Changes in the Procesing of Concurrent I-140 and I-485 Petitions and Applications

In light of Visa regression and in order to streamline I-140 and I-485 processing, the NSC has adopted the practice of adjudicating the I-140 that is part of a concurrent filing as if it were a stand alone I-140. If the I-140 is denied, the I-485 (and all other riding applications) will also be denied; however, if the i-40 is approved, the I-485 and any other riding applications will be returned to the work distribution unit.
This change will ensure that all I-140 petitions are adjudicated in the same timeframe with the goal of a six month processing time for all I-140's by September 30, 2005. This change will also enable the NSC to focus adjudicative attention on only the oldest I-485's instead of splitting between the oldest stand-alones and the oldest concurrent applications.
Finally, the specialization of having officers focus on either I-140 or I-485 adjudication instead of both should enable the NSC to achieve greater productivity on both.
