NO NEWS ON THE H-1Bs
USCIS is still not accepting H-1B applications for the 20,000 additional H-1Bs which were to be available beginning March 8, 2005. Similarly, there is no clarification regarding if the 20,000 will be only for individuals who received a master's or higher degree from a U.S. educational institution, as stated in the law; or if they will open the 20,000 new H-1Bs to all eligible candidates, as stated in the recent CIS press release. The CIS had not posted any information regarding this as of 3/22/05 and offered no indication when the information would be available.
Visas Mantis Security Checks
Another recent development affects those subject to the Visas Matnis security check. Individuals who apply for non-immigrant visas to come to the U.S. to work or study in any of the fields listed on the Technology Alert List are subject to a Visas Mantis security check. The Department of State has indicated that once a Visas Mantis check has cleared it will be valid for specific period of time, depending on the visa type, as follows:
- F-1 4 years
- J-1 2 years
- H-1B 2 years
- B-1 1 year
