Concurrently Filed I-140/I-485 Cases Will Be Adjudicated Concurrently
May 15, 2004
A procedural guidance memo from Fujie Ohata, Director of Service Center Operations, dated March 31, 2004 instructs the CIS service centers to process concurrently filed I-140s and I-485 together based on the I-140 receipt date. I-485s filed concurrently will no longer be tracked based on the local I-485 processing time. If required to complete the processing, RFEs for both the I-140 petition and I-485 application will be sent at the same time. The new procedures were to be implemented no later than April 30, 2004.
