Concurrent Filing of Employment-Based Visa Petition and Adjustment Application Allowed
July 31, 2002
As of July 31, 2002, Immigration and Naturalization Service regulations allow the concurrent filing of the I-140 Immigrant Petition for Alien Worker and I-485 Application to Adjust Status. This will eliminate the delay to foreign workers previously experienced between the approval of the I-140 and subsequent filing of the I-485 and will allow the foreign worker and family members to apply for employment authorization and advance parole much earlier in the overall process.
