Asylum or Refugee

You can apply for asylum in the U.S. if you are a foreign national who has fled to the U.S. (asylee) and can establish that there's a well-founded fear of persecution in your home country, based on race, religion, ethnic group, social group, or political opinion.

  • Asylees can work in the U.S. and may travel out of the country with a Refugee Travel Document
  • They may also bring their spouses and children to the U.S., provided the relationship existed before the asylum was granted
  • Asylees can apply for permanent residence status one year after they are granted asylum
